Conditions and Terms of Trade |
These terms and conditions apply to all transactions between the Buyer and Marshall Products Limited (MPL). |
1. Orders
Catalogue Numbers, Quote Reference Numbers (where applicable) and Purchase Order Numbers should be quoted in all cases. Orders should be addressed to:

2. Prices and Quotations
The price of the Goods will be at the quoted price (or if there is no quoted price then MPL list price on the date of Order) inclusive of any duties but exclusive of Value Added or other Taxes except where stated otherwise. All quotations issued by MPL for the supply of Goods shall remain open for acceptance for the lesser of 30 days or such period as stated in the quotation. Prices shall not include delivery, freight and insurance for which an additional charge will be made where applicable. In particular, a delivery charge of £12.00 will be made for orders below £500.00. If price variations occur within the validity period which are beyond the control of MPL, the quotation may be subject to change before or after the maturity date. MPL reserves the right to withdraw any offer made on goods or contracts at any time before acceptance. Delivery dates on quotations are quoted on stock positions prevailing at the time of the quotations and are liable to change without notice.
3. Delivery
Standard delivery is 2 - 3 working days from receipt of order. MPL will make every effort to deliver within the time period quoted, but no guarantee can be given. MPL reserves the option to supply all orders in partial shipments and to Invoice the same separately. When signing for the Goods, it is the Buyer's responsibility to notify MPL, in writing, within 14 days of receipt of short delivery or defects in respect of goods reasonably discoverable on careful examination. Any reports made outside of this timescale, will not be entertained. On receipt of a report regarding any discrepancies, MPL will send written acknowledgement of receipt of the query to guarantee that it will be dealt with and confirm it was received within the time frame. If this acknowledgement is not received it is the Buyers responsibility to contact MPL and ensure the discrepancy report was received. MPL will not be liable for any delay in delivery or non delivery due to reasons which are beyond it's control. These reasons may include, without limitations, restrictions by government authorities, fire, flood, strike, industrial disputes, breakdown of machinery, explosions, war and delay in delivery by MPL's suppliers or any other circumstances. Under any of the above, suspension, cancellation or extension of delivery may result at the discretion of MPL.
4. Title of Goods
All goods remain the property of MPL until paid in full by the Buyer.
5. Returns
Goods cannot be returned without the prior permission of MPL and the issue of a valid Goods Returned Form which must be attached to the outer carton packaging. Goods will not be accepted back for credit if returned after 30 days from the date of Invoice. MPL will arrange for collection and therefore the liability, should Goods be damaged or lost in transit, however, should the Buyer arrange their own Returns, MPL will not accept liability. Goods must be returned complete with the manufacturers packaging and instructions in an undamaged and resalable condition. A 10% Handling Charge will be applied to all returns where MPL is not liable.
6. Payment Terms
Payment for non credit account holders must be made by cleared payment before dispatch. The standard credit facility for account holders is 30 days from Invoice date unless otherwise agreed. MPL may, at any time, suspend credit terms and request payment for goods prior to delivery. MPL reserves the right to charge interest at 8% above base rate, under the Late Payment of Commercial Debts (Interest) Act 1998, per month on all accounts which are overdue for payment. Without prejudice to the above clause, MPL reserves the right at its option, to suspend further supplies and any of its services should the Buyer fail to make payment by the due date. MPL reserves the right to remove all discounts and apply list price to all outstanding invoices where the payment terms are not met.
7. Warranty
All goods come with a 12 month Manufacturer's Warranty. |
